Derek & Dakota

Terms & Conditions

Last updated: October 8, 2026

Please review these website terms before applying, scheduling a call, or considering a Derek & Dakota program.

1. Scope, acceptance, and business identity

These Website Terms & Conditions govern use of derekdakota.co and the Derek & Dakota website, free videos, applications, communications, and related educational content. In these Terms, “Derek & Dakota,” “we,” “us,” and “our” refer to Remote Business Academy LLC, the legal entity operating this branded website — not to Google, Meta, or any testimonial participant.

By using the website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, stop using the website. A purchase is subject to the offer and enrollment agreement provided before payment. These website Terms do not by themselves enroll you in a program or create a partnership.

Operator: Remote Business Academy LLC. Mailing address: 881 Baxter Drive Suite 100, South Jordan, Utah. Support email: Support@remotebusinessacademy.com.

2. Adults and accurate information

Our business education and application process are intended for adults aged 18 or older who can enter a binding agreement. You must provide accurate information, have authority to share the information you submit, and keep any account credentials confidential. Do not submit another person’s information without authorization.

Do not send Social Security numbers, bank credentials, complete card numbers, identity documents, or other sensitive information through general application or pre-call forms.

3. Education, not employment or an investment

Derek & Dakota offers education, resources, coaching, and support related to building a local-business Google presence and AI-supported service business. This is not a job offer, investment product, promise of passive income, or guarantee that customers will be supplied to you.

Calling participants “partners” does not create a legal partnership, franchise, agency, employment, fiduciary, or joint-venture relationship. Any such relationship would require a separate written agreement and compliance with applicable law. You remain responsible for operating your own business and making independent decisions.

4. Earnings, rankings, and results

EARNINGS DISCLAIMER: We do not promise or guarantee income, profit, clients, recurring revenue, Google rankings, or business success. Testimonials, partner wins, screenshots, and revenue figures describe selected individual experiences, not typical or expected results. We have not established a representative average or median participant result. Some participants may earn nothing or lose money. Revenue and monthly recurring revenue (MRR) are not net profit or take-home income and may be shown before operating costs, refunds, taxes, and other expenses. Outcomes depend on your skills, effort, sales ability, resources, market conditions, expenses, and execution. AI and automation do not eliminate work, costs, oversight, or risk. Do not purchase based on an expectation of guaranteed earnings or assume that you will recover your investment.

Statements about launch timelines, first clients, automation percentages, rankings, client retention, or scalability are not promises of your results. AI-assisted fulfillment varies by task, software, client needs, and operator expertise. Human review, sales, quality control, and ongoing client service remain necessary.

Any hypothetical calculator, projection, illustration, or demonstration is not a verified earnings result. Google determines rankings through its own systems; we do not control placement, profile approval, platform changes, or customer demand.

5. Testimonials and case studies

Testimonials and screenshots reflect selected reported experiences in their stated context. They are not a representative sample of all participants, and a selected result does not establish what a new participant is likely to earn. Different periods and metrics, such as gross volume, cash collected, booked sales, and MRR, must not be treated as interchangeable.

Revenue is not profit. Consider the relevant time period, business expenses, refunds, taxes, experience, and resources. A material connection, such as payment, free access, employment, or another incentive for a testimonial, must be disclosed with that testimonial when applicable. These Terms do not replace such disclosures or establish that every existing claim has been independently verified.

6. Applications and strategy calls

An application or call does not guarantee acceptance, availability, funding, customers, or results. We may assess fit based on your goals, experience, resources, and ability to execute, subject to applicable anti-discrimination laws.

Submitting a form or choosing a preferred program does not authorize a charge, commit you to purchase, or constitute separate consent to marketing texts. Use your appointment confirmation to cancel or reschedule a call. Any recording of a call must be disclosed and consent obtained where required by law.

7. Offers, payments, and financing

Before paying, review the written description of deliverables, access duration, support, price, currency, applicable taxes, installments, and any renewal or cancellation terms. We will not interpret website access as acceptance of an undisclosed subscription or charge.

Financing and third-party payment arrangements, if offered, are subject to the provider’s eligibility checks and separate agreement. Approval is not guaranteed. Financing may involve interest, fees, credit checks, or obligations that continue even if you stop using a program. Read those terms before accepting. Do not assume a refund or cancellation automatically ends a financing agreement.

Any recurring charge requires the applicable advance disclosures and authorization. These Terms do not authorize us to charge a payment method without your agreement.

8. Refunds, cancellations, and mandatory rights

Refund and cancellation terms for each program are provided in writing before purchase in the applicable enrollment or purchase agreement. For refund, cancellation, access, or installment questions, contact us at Support@remotebusinessacademy.com and include the email address used for the purchase. These Terms do not create a “no refunds” rule or promise a particular refund period.

A separate enrollment agreement may specify program-specific terms, but cannot override non-waivable consumer protections, applicable cooling-off rights, remedies for misrepresentation, or other statutory rights. Changes posted later do not retroactively remove rights attached to an earlier purchase.

9. Operating expenses and legal responsibility

Program fees are not the only possible cost of operating a business. Unless your written offer expressly includes them, you are responsible for software, advertising, lead generation, hosting, payment processing, subcontractors, insurance, registrations, licenses, professional advice, taxes, and other operating costs.

Our content is not individualized legal, tax, accounting, lending, or financial advice. You must determine the laws and platform rules that apply to your business and clients. Consult qualified professionals where needed. Do not spend money you cannot afford to lose or rely on expected program earnings to meet essential obligations.

10. Outreach, AI, and Google platform rules

You are responsible for lawful outreach and client fulfillment, including privacy, telemarketing, text-message, email, advertising, consumer-protection, and do-not-call requirements. A business phone number or publicly available contact record is not automatically consent to receive automated marketing. Do not use training to send unlawful messages or bypass opt-outs.

Use Google Business Profiles only with appropriate authorization and in accordance with Google’s eligibility and quality policies. Do not create fake reviews, deceptive listings, false locations, or unauthorized profile changes. AI outputs may be inaccurate or incomplete; review them before use and protect confidential client information.

11. Communications and SMS terms

Providing a phone number alone is not permission to send automated marketing text messages. Where a Derek & Dakota SMS program is offered, the sender, message categories, and applicable consent disclosure must be presented at the point of opt-in. Marketing and appointment/service messages must respect the scope of your separate consent where required.

If you affirmatively opt in, messages may include the appointment reminders, application updates, customer support, or promotional messages specified in that opt-in. Message frequency varies. Message and data rates may apply. Consent to marketing is not a condition of purchase.

Reply STOP to opt out of the relevant texting program or use another reasonable revocation method communicated to the team. You may receive a final opt-out confirmation. Reply HELP for help, or reply to your existing team email or use your designated support channel. Tell the team if your number changes or is reassigned. Wireless carriers are not liable for delayed or undelivered messages.

Marketing emails must offer a working unsubscribe method. Necessary transaction or service messages may still be sent where lawful. No provision in these Terms creates SMS consent retroactively. See our Privacy Policy for mobile information and consent handling.

12. Intellectual property and access

Original videos, training, templates, designs, and branding are owned by or licensed to their respective rights holders. Subject to a purchase agreement, you receive limited access for your own authorized learning and internal business use, not ownership of the underlying materials.

Do not share restricted account access, resell or publish training, remove attribution, or reproduce protected materials without permission, except as permitted by law or your written license. You retain ownership of your submitted information; submitting an application does not authorize public use of your name, image, or testimonial.

13. Acceptable use

Use the website lawfully and without harming other users or systems.

  • Do not impersonate others, submit materially false information, or harass team members or participants.
  • Do not introduce malware, attempt unauthorized access, or disrupt the website or connected services.
  • Do not infringe intellectual property, breach confidentiality, or publish another person’s private information.
  • Do not use our resources for deceptive advertising, unlawful outreach, fraudulent earnings claims, or prohibited platform practices.

14. Third-party services and independence

The website may use or link to independent providers, including Typeform, Vidalytics, Meta, Google, Skool, and payment or financing providers. Their availability, features, terms, and privacy practices are governed by their own policies. A reference or link does not imply ownership, sponsorship, or guaranteed performance.

Derek & Dakota is not part of or endorsed by Facebook, Instagram, Meta, Google, or YouTube. Their names and marks belong to their respective owners.

15. Website availability and warranties

To the extent permitted by law, free website content is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free content, or that third-party tools will remain available. Purchased-service obligations remain subject to your enrollment agreement and applicable law.

Nothing here excludes warranties or remedies that cannot lawfully be excluded, or excuses false or misleading claims.

16. Liability and consumer protections

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses resulting from use of free website content, third-party outages, or independent business decisions. This provision does not exclude liability for fraud, willful misconduct, or any liability that applicable law prohibits us from limiting.

No statement in these Terms waives mandatory consumer rights, lawful complaints to regulators, or rights that cannot be waived by contract. Any additional purchase-specific liability terms must be provided in the relevant agreement before purchase.

17. Suspension and termination

We may restrict website access where reasonably necessary to address unlawful activity, security threats, or material misuse. Restrictions on purchased program access are subject to the enrollment agreement and applicable law; this provision does not automatically forfeit payments or eliminate refund rights.

18. Disputes and applicable law

If a concern arises, first contact us through the Contact page, at Support@remotebusinessacademy.com, or through your purchase confirmation so it can be reviewed. These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. No mandatory arbitration clause or class-action waiver is imposed by this page; applicable law and any valid, separately agreed enrollment provisions determine venue and dispute procedures, subject to mandatory consumer protections.

19. Changes and severability

Updates will be posted with a revised date. Material purchase terms require the process applicable to your agreement and law, rather than retroactive amendment through this page. Continued website use after a lawful update may constitute acceptance for future website use only. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
